SLO man found guilty for murder of roommate

–A San Luis Obispo County jury found the defendant, Charles Chad Giese, guilty of the Nov. 15, 2015 murder of his roommate Walter Ernesto Vallivero, at their residence in rural San Luis Obispo. The verdict came after a three-week jury trial and two days of deliberation.

On November 15, 2015, San Luis Obispo County Sheriff’s deputies responded to an address in rural San Luis Obispo based on a 911 call from Giese’s mother. Upon arrival deputies located the body of the victim, Walter Ernest Vallivero (DOB 01/21/1961), within the residence. Giese and Vallivero had been roommates for approximately three months, during which time neighbors described a history of loud verbal arguments between the two men. During the investigation, Giese admitted to deputies that he had beaten Vallivero resulting in his death, but claimed it was in self-defense.

At the trial Giese’s attorney argued the killing was justified, claiming that Vallivero initiated the confrontation by first assaulting Giese. Giese did not testify at the trial. The physical evidence presented to the jury did not substantiate Giese’s account of being assaulted.

“While we can only imagine the impact this horrific crime has had on the family and friends of Mr. Vallivero, we are hopeful that this conviction will provide some solace. We thank the jurors who patiently and conscientiously evaluated this very difficult case,” said District Attorney Dan Dow.

Sentencing for Mr. Giese is scheduled for July 12, 2018 in Department 1 of the San Luis Obispo County Superior Court, the Honorable Judge Jacqueline Duffy presiding. Giese faces a sentence of 27 years to life in state prison.

The case was investigated by the San Luis Obispo County Sheriff’s Office and the San Luis Obispo County District Attorney Bureau of Investigations. The case was prosecuted by Deputy District Attorney Christopher Peuvrelle.

–On Monday morning, the Sheriff’s Office received a report of a suspicious death at 600 block of Rancho Oak Drive in rural San Luis Obispo. When Deputies arrived, they discovered the body of Walter Ernest Vallivero, 54, inside the home.

After detectives interviewed Vallivero’s roommate, 40-year-old Charles Chad Giese of San Luis Obispo, he was arrested. Investigators believe the two men had an argument on Sunday. The argument escalated and investigators believe the victim died from blunt force trauma.

Giese was booked into County Jail on one count of murder.

The investigation is on-going. No further information is available at this time.

Robbery reported at Hitching Post Shell gas station in Atascadero

–On Wednesday, at 3:34 p.m., officers from the Atascadero Police Department responded to a report of a robbery which just occurred at the Hitching Post Shell gas station located at 8000 Morro Road in Atascadero. It was reported the suspect entered the store, selected a bottle of water and confronted the clerk. The suspect stated he had a gun, motioned to his waistband as if he had one, and fled the store.

Officers arrived in the area and began conducting a search. Officers viewed video surveillance of the incident and were able to provide an accurate description of the suspect to other units in the area. Officers located the suspect matching the description on Morro Road near Portola Road and confronted him. The suspect failed to comply with officers commands and eventually fled on foot. Following a brief foot pursuit the suspect stopped, turned and assaulted pursuing officers. Officers used a Taser to subdue the suspect. No firearm was located.

The suspect was identified as Joseph Sage Bramon, 35-year-old Atascadero resident. Bramon sustained minor injuries from the incident and was later transported to a local area hospital for medical treatment prior to being booked into county jail for Robbery, Assault on an Officer and a felony warrant.

One officer sustained minor injuries the incident which required no medical attention.

Inmate escapes custody by walking away from Honor Farm facility

–On Wednesday at approximately 11:15 p.m., San Luis Obispo County Sheriff’s Office Custody staff discovered that an inmate had walked away from the Honor Farm facility on Kansas Ave.

The inmate was identified as 20-year-old Timothy Powers of Paso Robles. Powers was in custody at the Sheriff’s Office Honor Farm Facility for theft-related charges. Powers had removed his ankle monitor before escaping from the Honor Farm facility between the hours of 9 p.m. and 10:40 p.m. on Wednesday. Powers is on active San Luis Obispo County Probation, however he was not considered a threat to the public.

The Sheriff’s Office Detectives, Patrol, and Custody Staff engaged in a comprehensive apprehension effort. On Thursday at approximately 9:22 AM, Sheriff’s Office Deputies stopped a vehicle in San Miguel suspected of being associated with Powers. Powers was located in the front passenger seat of the vehicle and arrested without incident for escape from custody. The female driver of the vehicle, identified as 24-year-old Claudia Penaloza of San Simeon, was subsequently arrested for conspiracy. Both Powers and Penaloza were booked at the San Luis Obispo County Jail for the aforementioned charges.

Felipe Gonzales Alvarez (who has 40 plus aliases), 52, is wanted for 11 counts of identity theft and 11 counts of forgery/counterfeit.

Alvarez is 5’6″ tall, 240 pounds, and his last known address is unknown.

Merchants are asked to be on the lookout and notify the sheriff’s office immediately if they come in contact with Alvarez attempting to cash checks.

Felony child annoyance, molestation charges filed against local man

–After review of a case involving allegations of annoying or molesting a child under 18, the San Luis Obispo County District Attorney’s Office has determined there is sufficient evidence to file criminal charges against 43-year-old San Luis Obispo man Jonathan Oscar Davis for conduct in the City of San Luis Obispo occurring on June 25, 2018 at Sephora on Court Street.

He allegedly grabbed a 10-year-old girl’s hair at Sephora in the 1000 block of Court Street and left the scene when he was confronted by a witness, according to reports. A second complaint alleges Davis also touched an 8-year-old girl visiting the downtown area on Sunday.

The San Luis Obispo Police Department referred the case to the District Attorney’s Office for review of the evidence and to make a decision on whether charges can be filed.

On Thursday, June 28th the District Attorney’s Office filed felony charges against Jonathan Oscar Davis for annoying or molesting a child under 18 after having been convicted of a prior sex crime. This is a violation of Penal Code. It is also alleged that Jonathan Oscar Davis was previously convicted of felony child molestation in two prior cases in 2006, and of first-degree burglary, a violent felony, in a third prior case from 2001.

On June 29, Davis appeared for his arraignment in Department 1 of the Superior Court of the County of San Luis Obispo. At the arraignment, Defense Counsel declared a doubt as to Mr. Davis’ competency to stand trial and the Court referred the matter for a doctor’s evaluation. At the next court date, July 19, 2018, the Court will address this issue in Department 1 of the Superior Court, the Honorable Judge Jacquelyn Duffy presiding.

Police officers injured during drug-related arrest at local park

–On Tuesday at about 2:14 p.m., two Grover Beach Police Officers were conducting routine security checks of local area parks when they encountered a male adult inside the men’s restroom at Mentone Basin Park who was suspected of being involved in drug activity. The officers attempted to arrest the man and he resisted the arrest.

A violent struggle ensued which resulted in one officer sustaining moderate to serious injuries, the second officer sustaining minor to moderate injuries and the suspect, Trey A. Wilson sustaining minor injuries.

During the struggle, Wilson escaped from the officers and fled into the nearby neighborhood. An extensive search involving the law enforcement agencies from Pismo Beach, Arroyo Grande, Grover Beach, and the San Luis Obispo County Sheriff conducted a search utilizing K-9 dogs and numerous officers. Wilson was found about two blocks away and taken into custody without further incident.

An ambulance and the Five Cities Fire Authority were called to the scene to treat and transport the seriously injured officer to a local hospital for treatment. The second officer is being treated for minor to moderate injuries at another local hospital.

Wilson was also treated and released from a local hospital for his minor injuries. Wilson was booked into the San Luis Obispo County Jail on multiple charges.

Two arrested for armed robbery

–On Sunday at approximately 10:30 p.m., San Luis Obispo County Sheriff’s Office Dispatch received a call for service from a resident in the 1800 Block of Louise Ln., in Nipomo who reported they had just been robbed at knifepoint. The caller provided a description of suspects and the suspect vehicle, which had just fled the scene.

Less than 10 minutes later, responding deputies spotted a vehicle matching the description in the area of Riverside Rd. and Division St., Nipomo. The occupants of this vehicle attempted to flee when spotted by Deputies, which resulted in the suspect vehicle getting stuck in a field. The male occupants of the vehicle ran away. One male suspect was taken into custody immediately by Deputies. A second male suspect was taken into custody a short time later with the assistance of Sheriff’s Office K9 “D.J.” and CHP Helicopter 70.

Two male suspects are in custody on felony charges of PC 211 – robbery, 18-year-old Sergio Arturo Flores and 20-year-old Wilson Ricardo Cortez of Santa Maria. Personal property taken from the victims by the suspects was subsequently recovered. No injuries were reported by the victims. This is an active ongoing Sheriff’s Office investigation.

Santa Margarita man arrested for burglarizing neighbor’s home

–On June 25 at approximately 6 p.m. a deputy from the San Luis Obispo County Sheriff’s Department was dispatched to handle a residential burglary report where the victim felt that a neighbor may have been involved. The victim felt the neighbor was possibly involved due to past issues with him and the fact that the residence was unoccupied for less than a half-hour. He pointed out the neighbor’s residence to the deputy which was approximately 1/4 mile away. After the deputy processed the scene for evidence it was determined that 2 firearms, a tablet, and misc. items were taken in the burglary.

The deputy contacted the “Resident Deputy” for that area to inquire whether he knew the name of the possible suspect. He did and provided historical information to the deputy. The “Resident Deputy” program again proved it’s value in this investigation. Sheriff Parkinson feels it is imperative to have deputies in the rural areas assigned as “Resident Deputies” due to geographical challenges of our large county. This case is a great example of how the program was utilized to solve a crime very fast with one phone call.

The original deputy responded to the suspect’s residence where he was able to make verbal contact with the suspect. He was holding one of the described pieces of stolen property while he was inside a fenced in area with several dogs. The suspect would not exit the property. It was determined due to the hour the case would be followed up by the Detective Division the following day during daylight hours.

Detectives wrote a Ramey Warrant for the subject and a Search Warrant for the suspect’s property. A plan was formulated utilizing the “Resident Deputy’s” knowledge of the suspect and property. The suspect was taken into custody by the “Resident Deputy” without incident. All the stolen property was recovered during the warrant service.

Central Coast insurance agent sentenced for embezzling from employer

–Zachary Dale Jackson, 31, former insurance agent of Santa Maria, was sentenced to three years of formal probation, time served, and ordered to pay restitution totaling $4,388.92 after pleading guilty to one felony count of insurance fraud for embezzling from his employer.

After receiving a complaint from the insurance company, CDI investigators found that while working as an agent for the company, Jackson falsified insurance documents related to his own personal insurance claim. He also embezzled funds from the insurance company by writing multiple checks, totaling $4,388.92, to himself from the company’s account.

“I have zero tolerance for agents who violate the principles of their license and rip off insurers or consumers for their own financial gain,” said Insurance Commissioner Dave Jones. “Dishonest agents reflect poorly on the more than 350,000 licensed agents and brokers, most of whom do their best to be honest and professional in their business practices in California.”

The department’s investigation led to Jackson’s arrest in November 2017. Jackson’s agent license is revoked and he is barred from transacting the business of insurance. The case was prosecuted by the Santa Barbara County District Attorney’s Office.

Man barricades himself inside of Oceano home, threatens sheriff’s deputies

–On Saturday, at approximately 3:40 a.m., San Luis Obispo County Sheriff’s Office Deputies were called to the 1300 block of Norswing Drive in Oceano for a report of felony vandalism. The suspect, 42-year-old David Angello was reported to be smashing windows inside the residence he shared with a relative.

When deputies arrived, Angello retreated inside the home to a bedroom, brandished a weapon at the deputies and threatened them. The Sheriff’s Office SWAT team known as the Special Enforcement Detail (SED) was called out and quickly set up a perimeter around the house. For their safety, neighbors were evacuated or told to shelter in place in their homes. SED members were in constant contact with Angello during this incident.

At approximately 10:30 a.m., Angello stepped outside the home. At that time SED members utilized a less lethal use of force, a rubber projectile to disable Angello. SED members were able to apprehend Angello with the assistance of a Sheriff’s Office K9 and he was taken into custody without further incident. Angello was taken to a local hospital for a dog bite injury. After he’s cleared from the hospital, Angello will be transported to County Jail and will face charges of felony vandalism, brandishing a firearm at a peace officer and resisting a peace officer by means of threats or violence.

Both females fought the suspect, causing him to flee from the residence

During the early morning hours Friday, San Luis Obispo Police Officers responded to a residence in the 1500 block of Osos St. regarding an attempted sexual assault that just occurred. When Officers arrived, the suspect was no longer inside the residence and had fled the scene. Officers quickly set up a perimeter of the surrounding area. With the assistance of Officers from the University Police Department and a K-9 unit from the Paso Robles Police Department, a search of the area was conducted but unsuccessful in locating the suspect.

Two female victims in their 20’s told Officers that they awoke to an unknown male in their bedroom. The male suspect was holding a knife and threatened to harm them if they screamed. The suspect attempted to sexually assault both females. Both females fought the suspect, causing him to flee from the residence. Every available Officer responded to the scene and continued to search for the suspect and evidence. One witness reported that the suspect was seen running past the area of Osos and Leff towards the railroad station. Officers continued their search in that area but were unsuccessful in locating the suspect.

Evidence was collected from the crime scene and is being processed. During the investigation, it was determined the suspect made entry into the residence through an unlocked window.

The suspect was described as a Hispanic male in his 40s, 5’-7”, muscular, wearing black boxer shorts and a nylon over his head. When the suspect fled the crime scene, he was reportedly only wearing a black shirt and socks. The suspect description and actions are similar to the sexual assault that occurred on July 8 and we are looking into the possibility that the crimes may be related.

Police are currently seeking any video surveillance that may have captured the suspect entering or leaving the area of the 1500 block of Osos St. and the area of Osos St. and Leff St. towards the railroad station. –On Sunday, the San Luis Obispo County Sheriff’s Office was involved in a multi-agency probation compliance check conducted in Northern San Luis Obispo County. The agencies conducted a probation and parole sweep of those individuals who had probation or parole terms. Twelve people were arrested who either had charges or found not to be in compliance with the terms of their probation or parole.

Sheriff’s Deputies, San Luis Obispo County Probation, Paso Robles Police Department, Atascadero Police Department, Atascadero State Hospital Police Department, California Men’s Colony, and the California Department of Corrections Parole Unit were involved in the compliance check.

Specialized sweeps are conducted periodically across the county in an effort to deter crime and enforce probation terms of people released from custody or wanted on specific charges.
The following people were arrested along with their charges:

Shops in Atascadero, Morro Bay burglarized

–On Tuesday, at approximately 1 a.m., Atascadero Police officers responded to an alarm at Auto Zone, located at 8195 El Camino Real. Officers arrived on scene and located a broken front window to the business. Officers discovered vehicle batteries had been stolen from the business and began an investigation.

Approximately an hour later, Morro Bay Police Department responded to an alarm at a similar business in their jurisdiction. Another burglary was discovered with similar items being stolen. Video surveillance was reviewed by that agency and a “be on the lookout” was placed with local agencies for a vehicle involved in the burglary.

Deputies with the San Luis Obispo County Sheriff’s Office located a vehicle matching the description provided by Morro Bay PD traveling on Highway 41 near Atascadero Avenue in the City of Atascadero. A traffic stop on the vehicle was conducted with Atascadero PD units assisting. The occupants were removed from the vehicle at gunpoint and detained. Further investigation revealed stolen property from both the Atascadero and Morro Bay burglaries was in the vehicle. Both suspects were taken into custody by Atascadero PD.

The suspects were identified as Mario Aquino, 28 years old and Chris Casas, 20 years old, both Fresno, California residents. Aquino and Casas were booked into San Luis Obispo County Jail for Burglary, Conspiracy to Commit Burglary, Possession of Stolen Property and misdemeanor warrants.

Follow up investigation is being conducted by both the Morro Bay and Atascadero Police Department.

Local man charged with cocaine trafficking

Two California men have been charged in Effingham County, Illinois, with felony counts of controlled substance trafficking, according to XFM in Illinois.

A 31-year-old, Ivan Ochoa of Paso Robles, and 25-year-old, Miguel Escamilla of Madeira, California, were arrested by Illinois State Police Sunday in Effingham. Each man is accused of possessing more than 900 grams of cocaine, but the Effingham County State’s Attorney’s Office said the actual amount could have exceeded 35,000 grams.

The type of felony charged means mandatory prison time should a conviction result.

Escamilla and Ochoa are due in court Thursday for a status hearing. Bond for each man was set at $500,000.
