San Miguel CSD Director declares ‘war on gang crime’ after home burglary

County has seen increase in property theft, sheriff’s office says

Anthony Kalvans

Anthony Kalvans

–The home of San Miguel Community Services District Director Anthony Kalvans was burglarized on March 25. This marks the second burglary in the San Miguel area over the past several weeks, according to Kalvans. The director has now declared a “war on gang crime,” in the North County.

“Our hearts sank when we saw the broken glass,” said Kalvans about the discovery. “We’re fortunate the criminals did not make it very far into our home, but there is no place for this type of activity in our community.”

Kalvans said he and his father were returning home after having just finished volunteering at a local community fundraiser. “The time for action is now,” said Kalvans. “Crime has been on the rise for some time, and our county sheriff’s department has worked hard to combat the problem, but they need our support now more than ever.”

As San Miguel is not currently an incorporated area of San Luis Obispo County, very few county sheriff’s deputies are often patrolling the immediate area, “More streetlights and a dedicated resident deputy with k-9 unit patrol are just the beginning of what I think our community needs to combat this crime,” said Kalvans.

“The sheriff’s office doesn’t break down crime rates by individual locations but for the county as a whole, but I can tell you we have seen an increase in property theft in the county, overall,” said Sheriff’s Office Public Informations Officer Tony Cipolla. “We attribute this to prop. 47 which was passed by voters a little more than a year ago. It took crimes (mainly drug related) that were once considered felonies and reduced them to misdemeanors. So now, those drug cases are usually cited out, with no jail time (the jail provides access to drug rehab programs). Too many times, these same individuals have well established drug habits. So thefts are committed to help pay to fuel their habits.”

“As long as I serve on the CSD and The San Miguel Advisory Council, I will take a hard line on crime, and fight the safety of our communities,” said Kalvans. ” I ask the community to support my call to action and for my advisory council colleagues to join me in standing against gang related crime.”

A lifelong resident of San Miguel, Kalvans has served on the San Miguel CSD since 2012 and the San Miguel Advisory Council since 2011.

Judge orders release of convicted juvenile murderer

Under California law, a juvenile may only be incarcerated until 25th birthday

–The San Luis Obispo County District Attorney’s Office has announced that Superior Court Judge Linda Hurst has ordered the release of convicted juvenile murderer Roberto Roman Holguin, now 24, at the conclusion of today’s Reentry Disposition Hearing.

On March 14, 2016, the Juvenile Parole Board had granted Holguin’s early discharge from the Division of Juvenile Justice and returned Holguin to the jurisdiction of the San Luis Obispo County Superior Court. Holguin has remained in custody at the Division of Juvenile Justice since his conviction of first degree murder in 2006.

On February 17, 2006, Holguin, a resident of San Luis Obispo, was found to have committed murder in the first degree, residential burglary, robbery, elder abuse and vehicle theft. The victim was 87-year-old Gerald O’Malley. Holguin was tried as a juvenile because his age at the time of the offense, 13, precluded him from being tried as an adult. Holguin was sentenced by the Juvenile Court Judge to 42 years to life, however, due to his age, the potential confinement for his crimes totaled approximately 12 years. Under California law, a juvenile may only be incarcerated for a juvenile crime until his 25th birthday.

Governor Brown has twice reversed the Juvenile Parole Board’s earlier decisions to grant Holguin early discharge from custody, once in 2014 and again in 2015. This time, Governor Brown declined to exercise his authority to reverse the decision for early release. Holguin could have remained in custody for approximately eight additional months.

With this decision, Holguin will be escorted by San Luis Obispo County Probation officials to the State of Texas where he will live with a family member. Holguin will remain under the supervision of Texas authorities until his 25th birthday on December 15, 2016. It is hoped that this period of supervision will assist Holguin in his transition to independent adult life after having been in-custody since he was thirteen years of age.

“The District Attorney’s Office has done everything we could do from the very beginning in this very disturbing murder case,” said District Attorney Dan Dow.  “Mr. Holguin was convicted of first-degree murder and then sentenced to the maximum amount of custody that California law allows for a thirteen year old defendant. It is our hope that Mr. Holguin is remorseful for his brutal acts, that he fully appreciates his new freedom, and that he will commit himself to living a productive and crime-free life.”

This case was originally investigated by the San Luis Obispo Police Department and prosecuted by Deputy District Attorney Andy Baird.

The Coroner’s Unit of the San Luis Obispo County Sheriff’s Office has released the autopsy results for 37-year-old Brandy Ann Stanton of Creston and the newborn girl she had just delivered.

The mother and infant were brought by ambulance to the emergency room of Twin Cities Hospital on Saturday where they were pronounced deceased.

According to witnesses, earlier that morning, Stanton had been taking a bath at her home in Creston. Based on the totality of the circumstances, evidence at the scene, autopsy results and interviews, it was determined that while in the tub filled with water, Stanton gave birth to a live infant, the report says.

It was further determined, the baby took a breath or breaths above the water and then subsequently drowned, the report says.

Investigators determined Stanton had physically separated the umbilical cord from her body and was awake for a prolonged period of time after the baby was born. Evidence suggests Stanton’s family had not been aware of the pregnancy.

Coroner’s investigators have determined the cause and manner of death for the newborn as a drowning at the hands of another.

Coroner’s investigators have also determined the manner and cause of death for Stanton as natural by exsanguination, a severe loss of blood.

Since both the daughter and mother are deceased in this case, no criminal charges will be filed with the District Attorney’s Office.

Original report April 23:

Local mother and newborn die after delivery

Early Saturday morning, San Luis Obispo County Sheriff’s Deputies responded to Twin Cities Community Hospital Emergency Room after a mother and newborn infant were pronounced dead.

The mother and infant were brought to the emergency room at about 6:30 a.m. by ambulance in severe medical distress.

According to witnesses, 37-year-old Brandy Stanton was taking a bath at her home in Creston when she began yelling for help. A relative discovered Stanton and the baby she had just delivered in severe medical distress.

An ambulance was called and both were taken to Twin Cities Hospital Emergency Room where they did not survive attempts at resuscitation. As a result, the Coroner’s Unit of the Sheriff’s Office is conducting an investigation.

No foul play is suspected. No further information is available at this time.

Juan Carlos Landerosperez

–A California Highway Patrol pursuit that began in Monterey County ended in arrest on Monday in San Miguel.

On Monday night, Templeton CHP Units were advised that King City CHP Units were involved in a pursuit that was headed into San Luis Obispo County. Juan Carlos Landerosperez was reportedly driving a 2002 Nissan X terra the wrong way on the highway near the City of Salinas, causing three traffic collision, one which resulted in injuries to the other party.

The vehicle was driving southbound on Highway 101 trying to run other vehicles off the roadway, according to CHP. As the vehicle crossed into San Luis Obispo County, a Templeton CHP Unit took over primary position in the pursuit. The vehicle continued southbound on Highway 101 at speeds of 95 miles per hour. The vehicle continued to drive dangerously close to other vehicles, and swerved towards guardrails and bridge abutments, and the median causing dirt and debris to be thrown into the air, CHP says.

A second CHP unit set up a spike strip near the 10th Street Street Crossing in San Miguel where the two front tires of the suspect vehicle were successfully spiked. The tires eventually lost air and the vehicle came to a stop.

The suspect, Landerosperez, initially began to follow orders, but suddenly he jumped back in his vehicle and began to rev the engine. Officers had to forcefully remove Landerosperez before he attempted to drive away from the scene.

As officers removed Landrosperez he reportedly began yelling that the “Demons” were coming, and they were going to “get us all.”

Officers took Landrosperez into custody for DUI of drugs, battery on a peace officer, and evading a peace officer. Landerosperez was booked into the San Luis Obispo County Jail. One CHP Officer sustained minor cuts and abrasions during this arrest.

Joseph Mondo will serve time in San Luis Obispo County Jail after judge ruling Thursday

–Paso Robles resident Joseph Mondo, 20, on Thursday received a 75-day jail sentence in San Luis Obispo County Jail, 50 hours community service and will pay restitution, reports say. Mondo hit and killed a cyclist in his GMC Yukon and severely injuring her companion while reaching for his cellphone on Nov. 28, 2014 on Nacimiento Lake Drive, when he was 18 years old.

Mondo pleaded no contest in March to two misdemeanor counts of vehicular manslaughter without gross negligence and reckless driving for the November 2014 death of Lee Hekyung Craig, 62, of Los Angeles, reports say. Superior Court Judge Donald Umhofer on Thursday, sentenced Mondo to 30 days in San Luis Obispo County Jail, plus 45 days to be served consecutively for violating his probation. He will also have to perform 50 hours of community service and pay a yet-to-be-determined amount of restitution, reports say.

Lee Hekyung Craig, 62, of Los Angeles died after being hit on her Cervelo bicycle by a 2005 GMC Yukon driven by Mondo, a second rider, Lawrence Paul Chong, 59, of Seal Beach, was also struck in the accident while riding a Trek bicycle. Chong suffered major injuries in the accident and has undergone several surgeries.

The accident occurred at about 3:10 p.m. Friday, Nov. 28, 2014, on Nacimiento Lake Drive just east of Adelaida Road. Mondo was traveling westbound. He was distracted when his cell phone slid off his lap and he attempted to retrieve it. But before he was able to get it, he was forced to take evasive action to avoid a stopped vehicle preparing to make a left turn into a private driveway. Mondo steered on to the right shoulder around the turning vehicle and again attempted to retrieve his cell phone. As he reached for it, the Yukon veered onto the shoulder and struck the two bicyclists, he turned around at Adelaida Road, returned to the scene and, realizing he had hit the bicyclists, flagged down a passing car to call 911, as his phone turned out to be dead, reports say.

Craig was pronounced deceased at the scene. Chong was taken to Sierra Vista Hospital. Alcohol and drugs were not contributing factors. The CHP estimated Mondo was traveling about 60 mph in a 55 mph zone. The impact threw Craig 126 feet and Chong about 84 feet, reports say. Mondo was on probation for a misdemeanor exhibition of speed conviction from a month earlier, and had already received several infractions for speeding and other traffic-related offenses.

Mondo is scheduled to report to jail on July 15, reports say.

Jury found Jose Antonio Rojasbarriga guilty of abusing two boys under the age of fourteen

– A San Luis Obispo jury announced Thursday that they found 60-year-old San Miguel resident Jose Antonio Rojasbarriga guilty of thirty counts of sexual abuse where he victimized two male victims who were under the age of fourteen. The jury was unable to reach a verdict on one remaining count of sodomy, the San Luis Obispo County District Attorney reports.

Deputy District Attorney Julie Antos, assigned to the Sexual Assault and Child Abuse prosecution team, presented evidence over the course of a two-week trial that began on March 22. The evidence revealed that Rojasbarriga committed the repeated acts of child molestation over the course of nearly five years against the minors who lived in the same neighborhood.

“The young victims in this case, who are truly brave survivors, can now begin the long healing process because justice was served by these verdicts today,” said District Attorney Dan Dow.

The law allows for a consecutive sentence of 25 years-to-life for each count he was convicted of because the crimes were committed against separate victims on separate occasions.

The defendant faces up to 750 years-to-life in state prison. Sentencing is scheduled for May 6, 2016 in Department 6 of the San Luis Obispo County Superior Court where Hon. Judge John Trice presides.

Daniel Pettigrew.

–On May 18, 2016 at approximately 8 p.m. City of San Luis Obispo Police Department officers responded to an incident at 2700 block of McMillian, after reports of a subject violently causing damage to a brick planter box. From witness information, officers determined the suspect to be Daniel Pettigrew, a known local transient.

At approximately 9 p.m. officers in the area of McMillian Street saw Pettigrew walking at the dead-end near the railroad tracks, according to police reports. An officer attempted to make contact with Pettigrew and ordered him to stop. The officer was in marked patrol car, a police uniform and identified himself as a San Luis Obispo Police Officer. As he encountered the suspect, Pettigrew reportedly told the officer “back off I have a knife.” Within close proximity to the officer Pettigrew raised the knife with his hand in a manner that caused the officer to become immediately concerned for his safety and he drew his service weapon to address the threat.

With the knife still in has hand Pettigrew turned and walked away at which time the officer holstered his weapon and retrieved a less-lethal option from his vehicle. Officers followed Pettigrew, orders were made for him to stop; however, he failed to immediately comply. Ultimately Pettigrew stopped and was convinced to throw the knife on the ground. Officers were able to use minimal amount of force necessary to take Pettigrew into custody without further incident. No one was injured in this confrontation.

Pettigrew was transported to San Luis Obispo County Jail where he was booked for felony vandalism, assault with a deadly weapon and resisting arrest. Bail was set at $25,000.
